What should I say back when people say
1. You have no rights 2. Oh, wait a minute, yes, that guy had every right to search him, he's a minor! 3. Freedom of Speech applies to those over 18 only!

1. That is incorrect, as the Constitution states that rights are guaranteed to everyone, with nothing in there about age (except the voting age, and even then the wording of the amendment doesn't prohibit minors from voting per se)
2. #2 depends on the situation. Schools, as government institutions, have no right to search your belongings by the third amendment. However, parents have the right to search your stuff for any reason at all, whih is true but still egregious.
3. That is incorrect, as the Supreme Court has a record of supporting students' rights to freedom of speech most of the time, in cases like Tinker v. Des Moines. And even then, the First Amendment makes no basis on age and there is no law stating that anything coming from minors is automatically unprotected speech.

It's the fourth amendment. Third is quartering of soldiers.
1. In a free country, everyone has rights. This country was founded on the basis of giving all people (who are created equal) the inalienable rights to life, liberty and the pursuit of happiness. Nowhere do the Declaration of Independence or the writings of John Locke (on whose philosophy our government is based) mention age. In fact, many things in Locke's writings are extremely youth-friendly.
2. The fourth amendment applies to youth as well, although not alway to as great an extent. As the Supreme Court declared in New Jersey v. TLO, searches conducted on students by school officials do not require a warrant but must be reasonable and justified based on information the school has BEFORE the search has started, and also conducted in a reasonable manner given the age and gender of the student. Searches on youth conducted by police are restricted in the same ways as police searches on anyone else.
3. In a number of Supreme Court cases, it has been held that, to some extent, youth, even in school, have some rights under the 1st amendment. Such rulings have been made for freedom of speech (Tinker v. Des Moines), freedom of the press (Hazelwood v. Kuhlmeier) and freedom of Religion (Engel v. Vitale and Lee v. Weisman). Outside of school, young people's first amendment rights are generally consistent with those of adults.

"Thanks for your e-mail and I appreciate the fact that you articulated your viewpoint in a rational and cogent manner. A few questions though, Stefan. Who are you voting for in the Presidential Election this November? Kerry? Bush? Oh, you mean you can't vote? Why is that? What kind of car do you drive? Ford? Jeep? Oh you mean you don't drive. Why is that? Why is that you can't just stay home for the rest of the year and not go to school? Why?"
- New York City Councilman James Oddo, in a letter to me, October 2004.

Umm….if anyone actually said something like that in real life, I would probably stare at them and laugh really hard. The fact that anyone would say stuff that r-dickulously lame in real life is enough to make me giggle right now.

Freedom is acquired by conquest, not by gift. It must be pursued constantly and responsibly. Freedom is not an ideal located outside of man; nor is it an idea which becomes myth. It is rather the indispensable condition for the quest for human completion
-Paulo Freire
We must always take sides. Neutrality helps the oppressor, never the victim. Silence encourages the tormentor, never the tormented.

1. You have no rights – what about my UN human rights? The UN human rights includes voting. It's just that our government sweetly ignores it. 2. Oh, wait a minute, yes, that guy had every right to search him, he's a minor! – I've never worked in a coal mine in my life so I don't know how you can call me a minor. 3. Freedom of Speech applies to those over 18 only! – Where exactly does it state that in our law?
